Proposal\u00a0complementing\u00a0the\u00a0Directive\u00a0on\u00a0consumer\u00a0empowerment\u00a0for\u00a0the\u00a0green\u00a0transition.<\/strong><\/p>\n

In\u00a0March\u00a02023,\u00a0the\u00a0European\u00a0Commission\u00a0presented\u00a0a\u00a0proposal\u00a0to\u00a0regulate\u00a0environmental\u00a0claims.\u00a0The\u00a0proposed\u00a0Green\u00a0Claims\u00a0Directive\u00a0complements\u00a0the\u00a0February\u00a02024\u00a0Directive\u00a0on\u00a0Empowering\u00a0Consumers\u00a0for\u00a0the\u00a0Green\u00a0Transition.\u00a0The\u00a0latter\u00a0Directive\u00a0establishes\u00a0requirements\u00a0on\u00a0environmental\u00a0claims\u00a0and\u00a0prohibits\u00a0generic\u00a0claims\u00a0based\u00a0on\u00a0excellent\u00a0environmental\u00a0performance.\u00a0The\u00a0proposal\u00a0for\u00a0a\u00a0Directive\u00a0on\u00a0environmental\u00a0claims\u00a0complements\u00a0the\u00a0requirements\u00a0of\u00a0this\u00a0Directive\u00a0and\u00a0addresses\u00a0specific\u00a0aspects\u00a0and\u00a0requirements\u00a0for\u00a0explicit\u00a0environmental\u00a0claims.<\/p>\n

This\u00a0new\u00a0proposal\u00a0for\u00a0a\u00a0Directive\u00a0aims\u00a0to\u00a0avoid\u00a0misinformation\u00a0and\u00a0prevent\u00a0greenwashing\u00a0by\u00a0seeking\u00a0to\u00a0achieve\u00a0transparent\u00a0marketing\u00a0of\u00a0products\u00a0and\u00a0to\u00a0ensure\u00a0that\u00a0claims\u00a0included\u00a0on\u00a0labels\u00a0are\u00a0verifiable,\u00a0reliable\u00a0and\u00a0comparable.\u00a0To\u00a0this\u00a0end,\u00a0companies\u00a0must\u00a0include\u00a0substantiated\u00a0claims\u00a0according\u00a0to\u00a0established\u00a0requirements\u00a0and\u00a0the\u00a0information\u00a0used\u00a0to\u00a0substantiate\u00a0them\u00a0must\u00a0be\u00a0scientifically\u00a0based.\u00a0In\u00a0addition,\u00a0explicit\u00a0environmental\u00a0claims\u00a0must\u00a0be\u00a0assessed\u00a0to\u00a0substantiate\u00a0them,\u00a0taking\u00a0into\u00a0account\u00a0the\u00a0life\u00a0cycle\u00a0of\u00a0the\u00a0product\u00a0or\u00a0trader.\u00a0This\u00a0assessment\u00a0should\u00a0enable\u00a0the\u00a0identification\u00a0of\u00a0environmental\u00a0impacts\u00a0and\u00a0aspects\u00a0of\u00a0the\u00a0product\u00a0or\u00a0trader\u00a0that\u00a0affect\u00a0its\u00a0environmental\u00a0performance.\u00a0For\u00a0comparative\u00a0environmental\u00a0claims,\u00a0it\u00a0should\u00a0be\u00a0ensured\u00a0that\u00a0they\u00a0can\u00a0be\u00a0adequately\u00a0compared.<\/p>\n

Furthermore,\u00a0claims\u00a0must\u00a0be\u00a0assessed\u00a0and\u00a0also\u00a0verified\u00a0by\u00a0an\u00a0accredited\u00a0third\u00a0party,\u00a0and\u00a0information\u00a0on\u00a0the\u00a0substantiation\u00a0must\u00a0also\u00a0be\u00a0communicated\u00a0to\u00a0consumers.<\/p>\n

This\u00a0Directive\u00a0applies\u00a0to\u00a0voluntary\u00a0explicit\u00a0environmental\u00a0claims,\u00a0as\u00a0well\u00a0as\u00a0to\u00a0unregulated\u00a0voluntary\u00a0environmental\u00a0labelling\u00a0schemes.\u00a0Environmental\u00a0claims\u00a0subject\u00a0to\u00a0European\u00a0legislation\u00a0are\u00a0not\u00a0covered\u00a0by\u00a0this\u00a0Directive.\u00a0With\u00a0regard\u00a0to\u00a0labelling\u00a0schemes,\u00a0from\u00a0now\u00a0on\u00a0only\u00a0those\u00a0established\u00a0by\u00a0public\u00a0authorities,\u00a0or\u00a0schemes\u00a0based\u00a0on\u00a0a\u00a0certificate\u00a0of\u00a0conformity\u00a0issued\u00a0by\u00a0an\u00a0independent\u00a0verifier,\u00a0will\u00a0be\u00a0permitted\u00a0from\u00a0this\u00a0point\u00a0onwards.\u00a0Other\u00a0labels\u00a0that\u00a0are\u00a0already\u00a0subject\u00a0to\u00a0European\u00a0legislation\u00a0(e.g.\u00a0the\u00a0Ecolabel)\u00a0will\u00a0also\u00a0be\u00a0permitted\u00a0due\u00a0to\u00a0their\u00a0foundation\u00a0in\u00a0European\u00a0legislation.<\/p>\n

Member\u00a0States\u00a0must\u00a0implement\u00a0procedures\u00a0to\u00a0verify\u00a0the\u00a0justifications\u00a0and\u00a0the\u00a0communication\u00a0of\u00a0claims\u00a0by\u00a0a\u00a0verifier\u00a0issuing\u00a0a\u00a0certificate\u00a0of\u00a0conformity\u00a0with\u00a0the\u00a0requirements\u00a0for\u00a0the\u00a0label\u00a0or\u00a0claim.<\/p>\n

This\u00a0Directive\u00a0applies\u00a0to\u00a0all\u00a0companies\u00a0that\u00a0market\u00a0products\u00a0or\u00a0services\u00a0in\u00a0the\u00a0European\u00a0Union\u00a0and\u00a0that\u00a0include\u00a0environmental\u00a0claims\u00a0on\u00a0their\u00a0products\u00a0or\u00a0services.<\/p>\n
