On June 23, 2017, the Turkish Ministry of Environment and Urban Planning published the KKDIK regulation with similar scope to the EU REACH Regulation. The purpose is the regulation of procedures, administrative and technical principles regarding the safe use of chemicals in the Turkish market. In this way, it aims to guarantee a high level of protection for people’s health and the environment.
KKDIK is a Turkish acronym that refers to the registration, evaluation, authorization and restriction of chemicals.
The KKDIK (or Turkish REACH) replaces three existing regulations:
- The inventory and control of chemicals (ICRC), which was immediately replaced by the KKDIK regulation on June 23, 2017.
- Restrictions related to the production, supply to the market and use of certain dangerous materials, products and goods, repealed on December 23, 2017.
- The preparation and distribution of safety data sheets for hazardous materials and products, which will be replaced from December 31, 2023.
Regulatory scope of the KKDIK regulation
KKDIK covers the manufacture, introduction onto the market or use of substances as such or present in a mixture or in a product, as well as the introduction of mixtures of 1 tonne per year or more onto the market. Its scope is similar to that of EU REACH.
Not covered by KKDIK regulations
- Radioactive substances and mixtures
- Substances as such or present in a mixture or in a product, which are subject to customs control, provided that they are not subjected to any treatment or processing, and that they are under temporary storage, or in a free zone or warehouse with a view to for export or in transit.
- Non-isolated intermediate substances
- Transport of dangerous substances and mixtures by rail, road, inland waterway, sea or air
- Waste
- Substances and mixtures manufactured or imported for the purpose of defense
Exempt from registration
- Veterinary products
- Medicinal products
- Exported substances indicated in articles 27-28
- Reimported substances
- Cosmetics and medical devices
- Food and feed
- Products and processes for research and development (PPORD)
- Polymers
Included as registered substances
- The active ingredients for use in biocidal products, since biocides and their active agents are covered by the regulations for biocidal products (BPR).
- Active ingredients for use in plant protection products, since plant protection products and their active agents are covered by the directive on procedures and principles of plant protection products.
Registration
There are 2 steps in the KKDIK registration process, which are pre-registration (Pre-SIEF) and registration. Pre-registration began on December 23, 2017. Therefore, if pre-registration has been completed before December 31, 2020, the chemicals can be manufactured in Turkey or imported into the country until December 31, 2023. the latter being the deadline for the registration period. Substances that have not been registered under KKDIK (TURKISH REACH) before December 31, 2023 cannot be manufactured in Turkey or imported into the country.
The Turkish KKDIK – REACH requires a registration of all substances manufactured or imported into Turkey with a volume greater than or equal to 1 ton per year. From 01/01/2024 included, unregistered substances will not have access to the Turkish market.
Amendment to KKDIK (Turkey REACH) by December 2023:
According to the updated regulation, the new registration deadlines are:
31/12/2026 ?1000 t/a, CMR (Cat. 1A and 1B) substances ? 1t/a, as well as substances that are Aquatic Acute 1 and Aquatic Chronic 1 for substances ?100t/a
31/12/2028 ? 100 t/a
31/12/2030 ? 1 t/a
